1. Overview

This website is operated by OFFWHITECOLOR. Throughout these Terms of Service, the terms “we”, “us” and “our” refer to OFFWHITECOLOR.

These Terms of Service apply to your use of our website and to all purchases made through our online store. By visiting our website or purchasing a product, you agree to these Terms of Service, our Refund Policy and our Privacy Policy.

If you do not agree to these terms, you should not use the website or purchase our products.

2. Digital products

OFFWHITECOLOR sells digital colour products, including LUTs, Lightroom presets, conversion tools and related downloadable files. No physical product will be shipped.

The contents, formats, supported camera profiles, software compatibility and other relevant product specifications are described on the applicable product page. You are responsible for reviewing this information before completing your purchase.

3. Orders and payment

All prices are displayed in the currency shown at checkout. Any applicable taxes are calculated or included as indicated during checkout.

Payment must be completed before access to a digital product is provided. You are responsible for supplying accurate billing and contact information.

We reserve the right to refuse or cancel an order before delivery in cases of suspected fraud, payment failure, technical error, incorrect pricing or other legitimate reasons. If payment has already been collected for an order that we cancel, the amount paid will be refunded.

4. Digital delivery

Digital products are generally made available immediately after successful payment through a download page, email, customer account or another electronic delivery method.

Delivery is considered completed when the download link or access information has been made available to the email address or customer account provided during checkout.

You are responsible for entering a correct email address, downloading the files and storing a secure backup. We do not guarantee that download links or account access will remain available indefinitely.

If a download link does not work or a purchase is missing or incomplete, please contact us using the contact information provided on our website.

5. Licence and permitted use

Unless otherwise stated on the relevant product page, purchasing a digital product grants the purchaser a limited, non-exclusive, non-transferable and revocable licence to use the product.

You may:

Use the product in your own personal and commercial photography, film, video and audiovisual projects.
Use the product in an unlimited number of your own creative projects.
Use the product in work created for clients.
Deliver finished, rendered or exported images and videos incorporating the resulting colour treatment to clients or other third parties.
Adjust the application, intensity or surrounding colour grade as part of your creative workflow.

The licence applies only to the purchaser. A purchase does not transfer ownership of the underlying product or intellectual property.

6. Prohibited use

You may not:

Share, sell, sublicense, rent, redistribute or otherwise provide the original product files to another person or business.
Upload the original files to shared drives, public servers, marketplaces, forums, social media groups or file-sharing services.
Include the files in another LUT, preset, template, software or digital-product package.
Claim the files or their underlying colour transformations as your own product.
Copy, extract, convert, reverse engineer or modify the files for the purpose of creating or distributing a competing product.
Use the files in a way that infringes intellectual-property rights or violates applicable law.
Remove or alter copyright, authorship or licence information included with the product.

Clients may receive final rendered or exported work, but may not receive the original LUT, preset or other source files unless they have purchased their own licence.

For use by multiple employees, team members or separate users, each user must obtain a separate licence unless OFFWHITECOLOR has provided written permission or the product page expressly includes a multi-user licence.

7. Compatibility and creative results

Product compatibility is limited to the camera profiles, file formats and software stated on the applicable product page.

We do not guarantee compatibility with unlisted software, hardware, camera profiles, colour-management configurations or future software versions.

Colour results depend on factors including source footage, exposure, white balance, lighting, camera settings, colour management, software configuration and creative adjustments. Product images and examples are illustrative and do not guarantee an identical result on every image or project.

8. Refunds and right of withdrawal

Digital products are supplied or made accessible immediately after payment. Where required by law, by requesting immediate access and providing the required express consent, you acknowledge that your statutory right of withdrawal ends once delivery or access begins.

Refunds are governed by our Refund Policy. In general, purchases of successfully delivered digital products are final. If a product is missing, corrupted, incomplete, materially different from its description or otherwise defective, we will first attempt to restore access, correct the files, provide the missing content or supply a replacement.

Nothing in these Terms limits any mandatory right to repair, replacement, price reduction, termination or refund that applies under consumer law.

9. Intellectual property

The website, product files, colour transformations, branding, graphics, text, product descriptions, documentation and other original content made available by OFFWHITECOLOR are owned by or licensed to OFFWHITECOLOR and are protected by applicable copyright and intellectual-property laws.

Purchasing a product grants only the licence described in these Terms. It does not transfer copyright or any other ownership rights.

10. Third-party names and trademarks

Camera manufacturers, software products, film stocks, productions and other third-party names or trademarks may be referenced to describe compatibility, technical characteristics or creative inspiration.

Unless expressly stated otherwise, OFFWHITECOLOR is independent and is not affiliated with, sponsored by or endorsed by these third parties. All third-party trademarks remain the property of their respective owners.

11. Website availability and accuracy

We make reasonable efforts to keep the website and product information accurate and available. However, we do not guarantee that the website will always be uninterrupted, error-free or available.

We may correct errors, update product information or make reasonable technical improvements to our digital products. Any update will not reduce mandatory rights relating to products already purchased.

12. Third-party services

Our store may use third-party services for hosting, payment processing, digital delivery, analytics or other functionality. Your use of those services may also be subject to the applicable provider’s terms and privacy practices.

We are not responsible for interruptions or failures caused solely by third-party services outside our reasonable control. This does not affect any responsibility that cannot legally be excluded.

13. Limitation of liability

To the fullest extent permitted by law, OFFWHITECOLOR will not be liable for indirect, incidental or consequential losses, loss of profit, loss of business, loss of data or loss resulting from an unsupported or incorrectly configured workflow.

Where liability may lawfully be limited, our total liability relating to a product will not exceed the amount paid for that product.

These limitations do not apply where liability cannot legally be excluded or limited and do not affect mandatory consumer rights.

14. Privacy

Our collection and use of personal information are governed by our Privacy Policy.

15. Changes to these Terms

We may update these Terms of Service when our products, business practices or legal obligations change. Updated terms will be published on this page with a revised “Last updated” date.

Changes will apply prospectively and will not remove rights that already arose under a completed purchase.

16. Governing law

These Terms of Service are governed by the laws of the Netherlands.

If you are a consumer, you retain any mandatory protections provided by the laws of your country of residence. Nothing in this section limits any right you may have to bring a dispute before a competent court under applicable consumer law.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
